Event Ticket Purchase
1. General Information
1.1 These Terms & Conditions (hereafter "T&C") govern the sale of tickets for the Event “ITA meets SWITZ”, organized on the 7th October 2024 in Zurich, Switzerland (hereafter "Event"), by Elevate Momentum Partners GmbH, a company registered in Cham, Kanton Zug, Switzerland (hereafter "Organizer").
1.2 By purchasing a ticket, you (hereafter "Attendee") agree to comply with and be bound by these T&C.
1.3 The Organizer and the Attendee together referred as the “Parties”.
2. Ticket Purchase
2.1 Tickets can be purchased online through the official Event website at “www.itameetsswitz.ch”.
2.2 The purchase of a ticket constitutes a binding contract between the Organizer and the Attendee, subject to these T&C.
2.3 All ticket sales are final. Refunds, exchanges, or cancellations are not permitted, except as specified under Section 6 (Event Cancellation and Modifications), Section 7 (Force Majeure), and Section 8 (Attendee Cancellation Policy).
3. Payment
3.1 The ticket price is payable at the time of purchase. All prices are quoted in Swiss Francs (CHF), and include all applicable taxes, unless stated otherwise.
3.2 Payment can be made using the payment methods specified on the Event website. The Organizer reserves the right to modify the available payment methods at any time.
4. Ticket Transfer and Resale
4.1 Tickets are non-transferable and non-resellable, and are strictly nominal.
4.2 Any unauthorized transfer, resale, or attempted resale of tickets will result in the cancellation of the tickets without any refund.
5. Admission and Conduct
5.1 Attendees must present a valid ticket and identification upon entry to the Event.
5.2 The Organizer reserves the right not to accept any guest at the Event who shows up with a ticket not purchased in their name, since the Event’s venue has its own security standards, and the names of participants will be communicated in advance to its security service.
5.3 The Organizer reserves the right to refuse admission or remove any Attendee who behaves in a disruptive or inappropriate manner.
6. Event Cancellation and Modifications
6.1 The Organizer reserves the right to cancel or reschedule the Event for reasons including - but not limited to - unforeseen circumstances, force majeure, or safety concerns.
6.2 In the Event of cancellation, the Organizer will do its best to issue a refund of the ticket price.
6.3 In the case of rescheduling, the ticket will remain valid for the new date, and will not be refunded.
6.4 In the Event of cancellation or rescheduling, the Organizer is not liable for any additional costs incurred by the Attendee, such as travel and/or accommodation expenses.
7. Force Majeure
7.1 The Organizer shall not be held liable for any failure or delay in performing its obligations under these T&C due to circumstances beyond its reasonable control, including - but not limited - to acts of God, war, terrorism, civil commotion, governmental actions, fire, flood, epidemic, pandemic, or any other force majeure Events.
7.2 In the Event that the Organizer has to cancel the Event due to a force majeure Event:
the Organizer will notify the Attendees as soon as reasonably possible; the Organizer will not be responsible for any refund;
the Organizer is not liable for any additional costs incurred by the Attendee, such as travel and/or accommodation expenses.
8. Attendee Cancellation Policy
8.1 Attendees may cancel their tickets and request a full refund up to 30 calendar days before the Event date.
8.2 Cancellation requests must be submitted in writing via email to events@itameetsswitz.ch, including a copy of the original ticket.
8.3 No refunds will be provided for cancellation requests received less than 30 calendar days prior to the Event date.
8.4 The Organizer is not responsible for any additional costs incurred by the Attendee, such as travel and/or accommodation expenses, in case the Attendee decides to cancel his/her participation to the Event.
9. Photography and Media
9.1 By attending the Event, the Attendee grants the Organizer the right to take photographs and video recordings of the Event, which may include images or recordings of the Attendee.
9.2 The Organizer may use, reproduce, and publish these images and recordings in any media, including - but not limited to - online publications and promotional materials, without requiring a further consent from the Attendee, nor granting him/her any compensation.
9.3 If the Attendee does not wish to be photographed or video recorded, they must inform the Organizer in writing prior to the Event, and the Organizer will make all reasonable efforts to accommodate such requests.
10. Proprietary Information and Non-Disclosure
10.1 During the Event, the Organizer, the sponsors, the partners and/or other Attendees may share proprietary information and data (hereafter "Confidential Information").
10.2 The Attendee agrees to treat all Confidential Information as strictly confidential and not to disclose it to any third party without the prior written consent of the owner of such Confidential Information.
10.3 The Attendee agrees to use the Confidential Information solely for the purpose of participating to the Event, and not for any other purpose.
10.4 This obligation of confidentiality does not apply to information that is already in the public domain, was rightfully in the Attendee's possession prior to the disclosure, or is required to be disclosed by law.
11. Agenda Changes
11.1 The published agenda for the Event is indicative only. The Organizer reserves the right to make changes to the agenda, including the rearrangement of speakers and panels, at any time and for any reason.
11.2 The Organizer will make reasonable efforts to inform the Attendee of any significant changes to the agenda as soon as possible, via the contact details provided during the booking process.
11.3 Changes to the agenda do not entitle the Attendee to any refund nor compensation.
12. Food Intolerances and Allergies Disclaimer
12.1 By purchasing a ticket to this Event, the Attendee acknowledges and agrees that the Organizer shall not be held liable for any adverse reactions, including
but not limited to, allergic reactions or food intolerances, that may result from the consumption of food or beverages provided during the Event.
12.2 It is the responsibility of each Attendee to inform the catering team of any known food allergies or intolerances, prior to consuming any food or beverages at the Event.
12.3 The Organiser will make reasonable efforts to accommodate dietary restrictions, once notified in advance via the e-mail events@itameetsswitz.ch.
12.4 The Organiser cannot guarantee that all food and beverages served during the Event will be free from allergens and/or free from cross-contamination.
12.5 The Organiser strongly advises each Attendee with severe allergies or specific dietary needs, to exercise caution and consider bringing their own food to the Event if considered necessary.
13. Accessibility and Assistance Services
13.1 The Organizer strive to make its Events accessible and enjoyable for all participants. If any Attendee would require any specific assistance services related to mobility, hearing, or other accessibility needs, please notify the Organizer in advance via the e-mail events@itameetsswitz.ch.
13.2 Requests for such services must be submitted in writing at least 10 business days prior to the Event date. While the Organizer will make every effort to accommodate your needs, the Organizer cannot guarantee the availability of assistance services if requests are made after this deadline.
13.3 By purchasing a ticket and attending the Event, any Attendee acknowledge that failure to provide advance notice of the specific needs may result in the unavailability of certain assistance services, and the Organizer shall not be held liable for any inconvenience or difficulties that may arise as a result.
14. Liability for Personal Belongings
14.1 The Organizer shall not be held liable for any loss, theft, or damage to personal belongings or valuables brought by the Attendee to the Event. It is the sole responsibility of each Attendee to ensure the safety and security of their personal items during the Event.
14.2 The Organizer does not provide any secured storage or safekeeping services for personal belongings or valuables. Participants are advised to keep their possessions with them at all times, and to avoid bringing unnecessary valuable items to the Event.
15. General Liability
15.1 The Organizer's liability for any damages arising from the Event is limited to the ticket price.
15.2 The Organizer is not liable for any indirect, incidental, or consequential damages, including - but not limited to - travel and/or accommodation costs.
16. Privacy and Data Protection
16.1 The Organizer collects and processes personal data of the Attendee in accordance with the Swiss Federal Act on Data Protection (FADP).
16.2 By purchasing a ticket, the Attendee consents to the collection, the use and the processing of their personal data, for the purposes of the Event management and communication.
16.3 The Organizer will not share personal data with third parties without the Attendee's explicit consent, except as required by law.
17. Severability
17.1 If any provision of this T&C is held to be invalid or unenforceable for any reason it shall be adjusted rather than voided, if possible, in order to achieve the intent of the Parties to the fullest extent possible.
17.2 In any Event, all other provisions of this T&C shall be deemed and remain valid and enforceable to the fullest extent possible, unless such invalidity or unenforceability significantly restricts or changes the Parties' rights and obligations under this T&C.
18. Governing Law
18.1 This T&C shall in all respects be governed by and construed in accordance with Swiss law to the exclusion of Swiss private international law and any treaties (including the UN Convention on the sale of goods (CISG)).
19. Jurisdiction
19.1 Any dispute, controversy or claim arising out of or in relation to this T&C, including the validity, invalidity, breach, or termination thereof, shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland, the venue being Cham, Switzerland.
20. Acknowledgment of Terms and Conditions
20.1 By electronically accepting these T&C on the Organizer's website (www.itameetsswitz.ch), the Attendee confirms that they have read, understood, and agreed to all the terms and conditions set forth in this document.
20.2 The Attendee’s electronic acceptance of these T&C constitutes a binding agreement between the Parties. This agreement is enforceable in the same manner as a signed physical copy of these T&C.
20.3 By accepting these T&C electronically, the Attendee moreover acknowledges and agrees to the cancellation policy specified in Sections 6, 7 and 8.
20.4 The Attended agrees that their electronic acceptance of these T&C, and any associated documents, will be stored electronically by the Organizer, and will serve as a record of the Attendee’s acceptance and agreement.
20.5 The Attendee acknowledges that the Organizer reserves the right to amend these T&C at any time. Any amendments will be effective upon posting on the Event’s website (www.itameetsswitz.ch).
